Terms of Use

These Terms of Use (the Terms) govern your use of the iOS and Android app “tone” (the App), provided by pnly (the Developer).

Application of These Terms

These Terms apply to your use of the App. Depending on the store from which you obtained the App, the following terms also apply.

• App Store version: Apple’s Standard Licensed Application End User License Agreement (Standard EULA) also applies to the license for the App. If these Terms conflict with the Standard EULA regarding the license to the App itself, the Standard EULA controls.
• Google Play version: These Terms govern your use of the App as between you and the Developer. Your use of Google Play is separately subject to the Google Play Terms of Service and other applicable terms.

Outputs and Commercial Use

Images you create and export with the App (Outputs) may be used for both personal and commercial purposes. Permitted uses include publication on social media and websites, printed materials, advertising, product packaging, and incorporation into works offered for sale. No prior approval, license fee, or attribution to the Developer is required.

The Developer does not acquire ownership or copyright in images you import into the App (Source Images) or in Outputs. To the extent the Developer may hold any rights in the App’s image processing or visual effects as embodied in an Output, the Developer permits the uses described above. This permission does not license any third-party rights in Source Images or in works, trademarks, people, or other elements depicted in Outputs.

Your Responsibilities

You are responsible for obtaining all rights and permissions needed to process Source Images with the App and to use Outputs. You must ensure that your use does not infringe copyright, trademark, publicity, privacy, or any other third-party right and does not violate applicable law.

Prohibited Conduct

You must not:

• violate applicable law or any third-party right;
• interfere with the operation or availability of the App; or
• except as permitted by these Terms, the applicable store licensing terms, or applicable law, copy, modify, redistribute, or sell the App, its source code, UI, logo, or other materials.

Rights in the App

Rights in the App, its source code, UI, logo, website, and other materials provided by the Developer remain with the Developer or their respective rights holders. Permission to use Outputs commercially does not grant permission to use these materials.

Purchases

Purchases, payments, refunds, and other transactions made in the App are subject to the following terms, depending on the store from which you obtained the App.

• App Store version: The applicable terms of Apple and the App Store.
• Google Play version: The applicable terms of Google and Google Play.

Disclaimer

The App is provided “as is.” The Developer does not warrant that the App will meet a particular purpose, remain continuously available, or be free of defects. You are responsible for checking the rights needed for any use of Outputs, including commercial use. To the extent permitted by applicable law, the Developer is not liable for damages arising from use of the App or Outputs. Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law.

Changes to These Terms

The Developer may update these Terms when necessary. Material changes will be announced on this website or in the App. Updated Terms apply from the date they are posted on this page. However, an update will not retroactively restrict commercial uses that were permitted for Outputs when they were created.
